These Terms apply when you use boozecellar.com or place an order with EU & Booze Cellar, based in Santarém, Portugal. By ordering, you agree to these Terms together with the policies displayed on our website.
1. Eligibility and account information
You must provide complete and accurate contact, billing and delivery information. You are responsible for keeping account credentials secure.
EU & Booze Cellar does not sell or supply alcohol to anyone under 18. By entering this website, creating an account or placing an order, you declare that you are at least 18 years old and meet any higher legal age requirement that applies at the delivery destination. We may refuse or cancel an order and request age or identity verification where permitted by law. A false age declaration, the use of another person's account or payment method, or any attempt to bypass age controls may result in account restriction, cancellation of the order and referral to the competent authorities where legally required.
Parents and legal guardians are responsible for supervising minors in their care, restricting their access to this website and alcohol, securing accounts and payment methods, and using appropriate device or network parental controls. Any legal responsibility will be determined under the applicable law.
2. Products and availability
Products are subject to availability. Producers, bottlers and distributors may alter packaging, labels, appearance, vintage, alcohol content or bottle size. We aim to describe products accurately. Where an ordered item is unavailable, we may contact you, provide a close equivalent only where permitted by the product information and your order terms, or refund the unavailable item. Please check the bottle label and product information before consumption, especially where allergies or dietary restrictions apply.
3. Prices and payment
Prices and applicable taxes are shown during checkout. Delivery charges are calculated from the destination, parcel and service available. An order is accepted only after payment clears and we confirm or begin processing it. Obvious pricing or technical errors may be corrected; if this affects an order, we will contact you before fulfilment or cancel and refund the affected amount.
4. Dispatch, delivery and customs
Orders are dispatched after payment has cleared and internal processing is complete. Delivery estimates are estimates rather than guarantees. Tracking is provided where available. For deliveries outside the destination’s domestic customs area, the customer is the importer of record and is responsible for checking destination import rules and paying any duties, alcohol excise, import VAT, customs-clearing, handling or storage charges imposed locally. Booze Cellar supplies the certified commercial invoice required from us in Portugal but cannot complete or manage the customer’s local import procedures. We cannot refund losses caused solely by refusal to pay required import charges or by prohibited imports, except where applicable law requires otherwise.
5. Cancellations and returns
Contact us promptly if you wish to cancel. Cancellation may not be possible once preparation or dispatch has begun. Hygiene and safety restrictions apply to alcoholic beverages. EU customers may return unopened and untampered products within 14 days of delivery under the right of withdrawal. The customer is responsible for arranging and paying the return shipping costs. Return shipping costs are not refunded, and we do not provide prepaid return labels. All returned items undergo a health and quality inspection before any refund is approved. Opened, consumed, refilled or tampered products are not eligible for a change-of-mind refund. Missing, incorrect or transit-damaged orders should be reported promptly with the order number and supporting information so the appropriate delivery or carrier process can be followed. 6. Customer responsibilities
You must provide a deliverable address, monitor tracking, arrange receipt or collection, meet all legal age requirements and comply with destination laws. Risks created by incorrect addresses, missed collection, prohibited imports or refusal of lawful charges may remain the customer’s responsibility, subject always to mandatory consumer law.
7. Reviews and submitted content
Reviews and photographs may be held for moderation before publication. We may reject or remove unlawful, abusive, hateful, explicit, unsafe, deceptive, irrelevant or privacy-infringing material. By submitting content for publication, you confirm that you have the right to provide it and allow us to display it in connection with the store.
8. Website use and intellectual property
You may not misuse the website, attempt unauthorised access, introduce malicious code, scrape it unreasonably, impersonate others or reproduce protected store content for commercial use. Third-party trademarks remain the property of their owners.
9. Liability
Nothing in these Terms excludes liability that cannot legally be excluded, or removes mandatory consumer rights. To the extent permitted by law, we are not responsible for indirect losses that were not reasonably foreseeable when the contract was formed.

Personal information is handled as described in our Privacy Policy.
11. Changes and contact
We may update these Terms for legal, operational or security reasons. The version in force when an order is placed applies to that order. Questions may be sent to site@boozecellar.com.
